The ESC's MCU (microcontroller) is probably getting bad voltage information from a faulty component. I'd ask the vendor to replace it. If this has happened with several examples of this ESC, I'd ask for a different make or a different model from the same maker.

Probably got a bad lot of some component during it's manufacture.

It's never too late to have a happy childhood.
